SavvySpark AI Terms and Disclosure

This AI Terms and Disclosure document (“AI Terms”) describes how SavvySpark Inc. (“SavvySpark,” “we,” “us,” or “our”) uses artificial intelligence across all products available through the platform (the “Service”), including SavvySpark and any future products available through the platform. These AI Terms supplement our Subscription Agreement and Privacy Policy, and are incorporated by reference into those agreements. Capitalized terms not defined here have the meanings given in our Subscription Agreement.
1. AI-POWERED FEATURES
The Service uses third-party AI provided by Anthropic for extraction, search, classification, and recommendation tasks across the products available on the platform. The AI Features available in each product, and the data those features process, are described in the applicable Product-Specific Terms. The current sub-processor list is at DPA Annex III.
2. HOW YOUR DATA IS USED BY AI
2.1 Input Data
When you use AI-powered features, certain data from your account (such as contacts, companies, interaction history, meeting notes, and relationship data) is transmitted to our AI infrastructure for processing. Your inputs are used solely to generate outputs for you within the Service.
2.2 No Model Training
Your data is NOT used to train AI models. We use Anthropic’s commercial API, which contractually prohibits using customer data for model training, fine-tuning, or improvement of AI or machine learning models. This commitment applies to both our proprietary systems and our use of third-party AI providers.
We do not use your Customer Data, including inputs to or outputs from AI features, to train, improve, or develop AI or machine learning models, except:
(a) With your explicit consent; (b) To improve our abuse detection and safety systems; (c) In anonymized, aggregated form that cannot identify you or any individual.
2.3 Data Minimization
We submit only the data necessary for each AI feature to function. We do not send your entire dataset to AI providers for each interaction.
2.4 AI Interaction Retention
AI input and output data is retained for ninety (90) days for quality assurance and abuse prevention purposes, consistent with Section 6.1 of our Privacy Policy. After this period, AI interaction logs are deleted. Our AI provider (Anthropic) may retain limited data for security and abuse prevention purposes in accordance with their commercial terms.
3. AI-GENERATED OUTPUTS
3.1 General
AI Features generate classifications, recommendations, summaries, and other outputs. These outputs are informational tools — they are not guarantees of any outcome and should not be relied upon as the sole basis for business decisions.
3.2 Product-Specific AI Output Disclosures
Detailed information about AI feature behavior, factors, limitations, and your rights regarding AI outputs is provided in the applicable Product-Specific Terms. This includes the logic involved, the data used, and applicable regulatory disclosures (GDPR Article 22, Colorado AI Act). For algorithmic relationship scoring, see Privacy Policy Sections 7.1, 10.4, and 11.4.
4. HUMAN OVERSIGHT
4.1 Review Before Entry
Where AI Features extract or generate structured data from your inputs (such as meeting debrief extraction), the extracted data is presented for your review before it enters your records. No AI-generated data is added to your records without your confirmation, except for automated features (such as classification and suggested actions) that operate continuously on existing data. Algorithmic relationship scoring is not an AI Feature and is governed by the Privacy Policy.
4.2 Informational Outputs
All AI-generated outputs — including insights, recommendations, classifications, and extractions — are provided as informational aids only. You retain full control over how to interpret and act on AI-generated outputs. No automated decisions with legal or similarly significant effects are made solely on the basis of AI outputs without human review.
5. OUTPUT OWNERSHIP
As between you and SavvySpark, you own the AI-generated outputs produced from your inputs, including extracted data, insights, recommendations, and generated content. Your underlying Customer Data remains your property at all times. Algorithmic relationship scores derived from your data are likewise yours as between you and SavvySpark, subject to the Subscription Agreement.
You acknowledge that:
- AI outputs may not be subject to copyright protection under current law, as AI-generated content may lack human authorship sufficient for copyright registration.
- AI outputs may be similar to outputs generated for other users with similar inputs.
- We make no representations regarding the copyrightability or uniqueness of AI outputs.
6. ACCURACY DISCLAIMER
AI-generated outputs may contain errors, inaccuracies, or incomplete information. AI features are provided for informational and assistance purposes only.
YOU ACKNOWLEDGE THAT:
- AI outputs are generated by machine learning systems and may be incorrect, incomplete, or biased.
- AI outputs should not be relied upon as professional advice (legal, financial, or otherwise).
- You are responsible for reviewing, verifying, and validating all AI outputs before use.
- Similar inputs may produce different outputs at different times.
- AI capabilities have inherent limitations.
We do not guarantee the accuracy, reliability, completeness, or appropriateness of any AI-generated content. You use AI features at your own risk.
7. AI ACCEPTABLE USE
When using AI-powered features, you agree not to:
- Submit inputs designed to generate illegal, harmful, or deceptive content
- Submit inputs that infringe third-party intellectual property rights
- Submit inputs designed to circumvent AI safety measures or “jailbreak” the AI
- Use AI features for purposes of competitive reverse engineering or model extraction
- Use AI outputs to generate spam, phishing, or fraudulent content
- Represent AI outputs as human-created professional advice without appropriate disclosure
- Use AI outputs for automated decision-making with legal effects on individuals without human review
- Use AI features for unauthorized surveillance, profiling, or harassment

8. THIRD-PARTY AI PROVIDER
8.1 Provider
SavvySpark uses Anthropic’s Claude models via commercial API to power AI features. Anthropic maintains its own acceptable use policy, which restricts certain categories of content and use cases. SavvySpark’s Acceptable Use Policy reflects these restrictions — you do not need to separately review Anthropic’s policies, but you may do so at https://www.anthropic.com/policies/aup.
8.2 Provider Commitments
Under Anthropic’s commercial API terms:
- No training on customer data: Anthropic does not use commercial API customer data for model training.
- Customer owns outputs: Anthropic grants customers ownership of outputs generated from their inputs.
- Copyright indemnification: Anthropic defends commercial API customers from copyright infringement claims arising from authorized use of their services and outputs.
8.3 Provider Limitations
AI features are powered by third-party services subject to their own limitations, including rate limits, model version updates, content filtering, and safety measures. We will use reasonable efforts to provide notice of material changes to third-party AI services but are not liable for changes beyond our control, including model deprecation, capability changes, or service interruptions.
9. LIABILITY
WITHOUT LIMITING THE GENERAL LIMITATION OF LIABILITY IN OUR TERMS OF SERVICE:
(a) WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM:
- Inaccuracies or errors in AI-generated outputs or recommendations
- Inaccuracies or errors in algorithmic relationship scores
- Your reliance on AI outputs or scores without independent verification
- Business decisions made based on relationship scores or AI-generated insights
- Third-party AI provider outages, limitations, or changes
- Changes to third-party AI models or capabilities
(b) YOU ASSUME ALL RISK associated with your use of AI-generated outputs and agree to verify outputs before relying on them for any purpose.
10. OPT-OUT AND CONTROL
10.1 Feature Controls
Certain AI features may be disabled in your account settings, where technically feasible.
10.2 Opting Out
To request changes to how AI features process your data, or to inquire about disabling specific AI features, contact us at privacy@savvyspark.ai.
10.3 Your Rights
You have the right to:
- Understand the logic: Request meaningful information about how AI features process your data.
- Human review: Request human review of any AI-generated classification or recommendation.
- Contest outcomes: Challenge AI-generated classifications or recommendations you believe to be inaccurate.
- Disable AI features: Request that certain AI features be disabled for your account where technically feasible.
For your rights regarding algorithmic relationship scoring (which is not an AI Feature), see Privacy Policy Sections 7.5, 10.4, and 11.4. For additional details on your rights regarding automated processing more generally, see Section 7 of our Privacy Policy.
11. REGULATORY COMPLIANCE
11.1 AI Transparency
SavvySpark is committed to transparency in its use of AI. We disclose which features use AI, what AI models power them, and how your data is processed, as described in this document and our Privacy Policy.
11.2 Evolving Regulations
SavvySpark monitors evolving AI regulations, including the Colorado AI Act (effective February 2026), which requires impact assessments for high-risk AI systems, and similar legislation in other jurisdictions. We will update our practices and this disclosure as required by applicable law.
SavvySpark does not use AI features for high-risk purposes such as employment decisions, credit scoring, or other automated decision-making with legal or similarly significant effects on individuals. AI-generated outputs across all products are business intelligence and productivity tools and are not used to make decisions about individuals’ access to essential services, employment, credit, or other legally significant outcomes.
11.3 EU AI Act
Where applicable, SavvySpark complies with the transparency requirements of the EU AI Act, including disclosure of AI system capabilities and limitations, and enabling human oversight mechanisms.
12. CHANGES TO THESE TERMS
We may update these AI Terms from time to time. If we make material changes, we will notify you by posting the updated AI Terms on our website and updating the Effective Date. Your continued use of AI features after such changes constitutes acceptance of the updated terms.
